PALM BEACH CLUB CONDOMINIUMS - RULES AND REGULATIONS

These rules are effective as of July 16, 2007 and supersede any and all other previous rules and regulations issued by the Association.

 

It shall be the responsibility of each owner who rents their condominium to provide a copy of these rules to each tenant and to assure that their rental agent does the same.  Post each page separately in clear plastic on the refrigerator door.

 

The spirit of these regulations is to provide rules so that all may recognize and respect the rights and privacy of others.  All persons:  owners, guests, and tenants are required to adhere to these rules and regulations for the good of everyone.  Violators of the following rules are subject to eviction in which all deposits, rents and/or fees will be retained as liquidated damages to property, tranquility and peaceful enjoyment by other occupants.  Occupants are responsible for all acts of their children, other family members, their friends, or guests.

 

BALCONIES AND WALKWAY RAILINGS:  Do not hang towels, banners, flags or other objects over any railings.  Management may remove these from public walkways.  The only exception to this rule is a Florida State Statute which provides “Any unit owner may display one portable, removable United States flag in a respectful way and, on Armed Forces Day, Memorial Day, Flag Day, Independence Day, and Veterans Day, may display in a respectful way portable, removable official flags, not larger than 41/2 feet by 6 feet, that represent the United States Army, Navy, Air Force, Marine Corps, or Coast Guard, regardless of any declaration rules or requirements dealing with flags or decorations.”  No objects (fluids, cigarette butts, food, ice, etc.) shall be thrown to or from the balconies/common walkways.  No sitting or climbing on or hanging from the balcony rails.  Bird feeders and feeding of sea gulls is prohibited.

 

BOATS AND WATERCRAFTS:  Any beaching or mooring of watercrafts is at your own risk; the HOA is not responsible for personal watercrafts.  Watercraft trailers may not be parked in the common parking areas on the property at Palm Beach Club.  All watercrafts and trailers in violation of these rules will be towed at the owner’s own expense without further notice.

 

CHILDREN:  All minors must be supervised by someone over the age of 16 at times on Palm Beach Club Property.  Owners and/or tenants will be assessed for any damages.

 

FIRE ALARMS:  Fire alarm pull boxes are located on the second (2nd) and third (3rd) levels of stairwells and adjacent to each elevator entrance.  Pull boxes are for emergency use only.  False alarms are punishable by fines or eviction.

 

FIREPLACES:  Renters and guests are not permitted to have wood fires.  They may use artificial fire logs as long as the accompanying directions and cautions are followed.  Owners should supply proper fireplace tools.  Note:  A fire extinguisher should be located under the kitchen sink.  A second fire extinguisher by the fire place is HIGHLY recommended.  Do not store firewood in the carports.

 

FIREWORKS:  Prohibited.

 

GARDEN HOSES:  Must be equipped with a nozzle that automatically stops water flow when not actively being used.

 

GATES AT ENTRANCE:  Pedestrian traffic should watch for moving gate arms.  No tailgating thru the gates.  Enter the security code and drive one vehicle at a time through the gate. Those owners, guests or renters caught damaging or driving through the gate arms will be held financially responsible for the damage.

 

GAZEBO:  Only homeowners may reserve the gazebo.  The gazebo may be reserved by contacting the management company.  The gazebo cannot be reserved on Saturday, Sunday, or holidays between Memorial Day through Labor Day.  The number of people shall not exceed twenty-five (25).  Cooking is not allowed in the gazebo area.  Do not remove gazebo furniture.

 

GRILLS & BURNERS:  Renters are not allowed any outdoor cooking.    Charcoal grills are not allowed anywhere on Palm Beach club property due to fire hazard.  Owners are not allowed to cook outdoors in the garage carport areas or under the balconies.  Owners and long-term lease-holders (6 months or longer) may keep gas or electric grills on balconies, but are urged to be considerate of other occupants.  Proper caution and attendance are required.  Owner is responsible and liable for all of their outdoor cooking.

 

NOISE, RIGHTS/COMFORTS:  The hours between 10:00 P.M. and 9:00 A.M. are designated as quiet time.  No person shall make or permit any noise or take or permit any action which will interfere with the rights, comforts, or convenience of others.  No musical instruments, music, televisions or movies are to be played in a manner that disturbs other condominium occupants.  The Management may refuse accommodations at any time to any person whose conduct on premises displays intoxication, profanity, or brawling; who indulges in lewd language or conduct; who illegally possesses or deals controlled substances or whose conduct constitutes a nuisance.  Any of these behaviors can constitute an eviction or ejectment from the property.

 

OCCUPANCY LIMITS:  A maximum of six (6) persons per two-bedroom unit and eight (8) persons per three-bedroom unit.  The person who makes the reservation and pays for the unit must be over 25 years old and must be one of the guests staying in the unit.  Rental agents are responsible for advising renters concerning these occupancy limitations and providing these Rules and Regulations and the proper parking passes.

 

PARKING:  Vehicles parked on-site must be marked with the proper Palm Beach Club parking permits, either stickers or hanging tags as provided by the Association (two of each will be provided to each owner; there will be a charge of $20.00 for each replacement permit.)  All owners are responsible for obtaining the proper parking permits for themselves and their guests.  No boats, jet skis, RV’s or trailers are allowed to be parked in the common area or guest parking places.  Each unit has two in-line parking places.  Boats and jet skis may be parked only in the units designated area.  Boats, jet skis, trailers, etc. may not infringe upon accessibility of vehicles or storage facilities of adjacent units and must be parked within the lined parking space.  Any unsafe boat or vehicle, leaking fuel or other fluids, will be removed or towed at the owner’s own expense and own resolution.  Gasoline is extremely flammable.  Owners/Tenants are requested to be very cautious when fueling boats or jet skis.  They should not fuel in the vicinity of the air conditioner compressors and should use only approved gasoline storage containers.  Observed safety violations will be reported to the board of directors and may result in the owners/tenants loss of the privilege to store a boat or jet ski on the premises.  Owners (only) are allowed to park one (1) common vehicle defined to be a car, truck, SUV or other vehicle generally used for the non-commercial use of the owner and specifically excluding items such as boats, trailers, jet skis, motor homes, motorcycles, and the like in the non-assigned parking spaces, but only when their two designated spaces are filled with common vehicles (not boats/trailers/motor homes/motorcycles, etc.).  Vehicles without proper parking permits or in violation of parking rules can result in towing of the vehicle at the vehicle owner’s own expense and own resolution.

 

PETS:  Usual and ordinary domesticated pets are allowed by the Palm Beach Club Association.  Owners and 3-month or longer tenants are allowed no more than two pets.  Rentals less than 3-months and guests are not allowed to keep pets.  Dogs should weigh no more than 50 pounds.  Owners of pets must maintain immediate control of pets at all times and must not allow them to run at large.  Pets must be on leash (not to exceed 16 feet) at all times.  No pets may be kept in any portion of the common elements.  Pets are not allowed on the beach or in the pool area, and must be carried or under control in elevators.  Owners must immediately remove and dispose of any pet excrement deposited.  Pet owner assumes full responsibility for behavior of their pet and any damage caused thereby.  All pets shall be properly attended at all times and shall not be permitted to cause any nuisance or annoyance of any sort whatever to any of the occupants of the units.  Should any of these rules be broken the Board of Directors shall have the right, with a five day written notice, to require the pet to be permanently and immediately removed from the condominium property.

 

POOL:  NO LIFEGUARDS ON DUTY.  The use of the swimming pool and beach area is at guests’ own risk.  The Association and Management assume no liability.  Rules governing use of the pool are posted in the pool area.

 

POOL HOURS:   NOVEMBER 1 thru FEBRUARY 28             9:00 A.M. to SUNSET

                          MARCH 1 thru OCTOBER 31                     9:00 A.M. to 10:00 P.M.

 

          *POOL OCCUPANCY MAXIMUM OF FOURTEEN (14) PERSONS.

          *SHOWER BEFORE ENTERING POOL.

          *NO FOOD, DRINK OR ANIMALS IN POOL OR ON POOL DECK.

          *PER ESCAMBIA COUNTY HEALTH DEPARTMENT

 

Children under three (3) years of age must wear swim diapers and rubber pants if using the pool.

Children under thirteen (13) years of age must be supervised by an adult within the immediate pool area.

The use of floats and toys in the pool should be controlled when there are many people at or in the pool; please be courteous to others.

 

ęTHE FOLLOWING ARE NOT ALLOWED:

    ęGlass containers/bottles in the pool or beach area.

    ęProfanity or loud, disruptive conversations.

    ęAbsolutely NO loud music permitted.

    ęDiving, running, or horse play in pool and pool area.

    ęRemoving chairs, lounges and tables from pool area.

    ęLeaving towels or personal items on chairs to reserve chairs.

 

When leaving the pool area for the night, please remove all personal items.  Any personal items left behind may be disposed of by maintenance.

 

SKATEBOARDS, SCOOTERS, ROLLER SKATES AND ROLLER BLADES:  No skateboards, scooters, roller skates, or roller blades are allowed at any time on property, in the elevators, stairwells, buildings, walkways, pool area or parking lot.

 

SPEED LIMIT:  FIVE (5) MPH maximum speed within the complex.

 

TRASH:  Trash/garbage is to be secured in plastic bags and placed in the dumpsters.  Dumpsters are located behind gates on the east and west ends of the complex.

 

WALKWAYS:  Tenants shall not loiter or play on the walkways, elevators, or stairways.  Walkways are to be kept clear at all times.  No trash, sporting equipment, toys, shells, shoes (beach or flip-flops), beach items or other items are to be left unattended outside the individual units in the walkways or other common areas (pool, etc.).

 

WINDOWS:  Do not display banners, flags, reflective items, etc. in windows.  All window treatments, the outside of which face the common elements, must be of white or off-white color.
